Assalamalekum siraj bhai mera sawal hai agar koi shaks zeena karta hai aur islami hukumat ke mutabiq use sangsaar ki saza ho jaye wo us saza se razi ho ya na ho use saza hojaye to kiya aakhirat me us gunah se bari hoga ya nahi

Jawab:
Insha ALLAH wo zarur iss gunah se bari hoga, chahe wo iss saza ke iqrar ke baad iss par razi rahe ya na rahe.

Iss ki daleel wo mash’hoor hadith hai jo sahihain yani muttafaqun alaih hadith mein hai (yani sahee bukhari wa sahee muslim)
Ek shaks Ma’aiz bin malik (r.a.) nabi-e-kareem s.a. ke paas hazir ho kar apne zina ka iqrar karte hain. Phir nabi s.a.w. unhein sangsaar karne ka hukum dete hain.
Jab log unhein sangsaar karna shuru karte hain to wo phataraun ki barish bardasht na kar ke wahaan se bhag khade hote hain, yahaan takk keh unn ko muqam-e-harra par pakada jaata hai phir unhein wahein rajam kiya jaata hai yahaan takk keh wo thande ho jate hain.
Iss talluq se, Haidth mein iss tarah alfaz aaye hain,
…فَرَمَيْنَاهُ بِالْعَظْمِ، وَالْمَدَرِ، وَالْخَزَفِ، قَالَ: فَاشْتَدَّ، وَاشْتَدَدْنَا خَلْفَهُ حَتَّى أَتَى عُرْضَ الْحَرَّةِ، فَانْتَصَبَ لَنَا فَرَمَيْنَاهُ بِجَلَامِيدِ الْحَرَّةِ – يَعْنِي الْحِجَارَةَ – حَتَّى سَكَتَ …

Tarjuma:
Abu saeed khudari r.a. kehte hain,
Hum ne uss ko haddiyaun, dhelaun aur thikaraun se maara. Wo daud kar bhaaga, hum bhi uss ke peeche bhage, yaahan takk keh usse HARRAH mein paakada. Humne usse harra ke phattaraun se maara, yahaan takk keh wo thanda ho gaya.
(Sahee Muslim : 4428)

Iss tukade se maloom huwa keh saza se razi ho ya na ho, wo saza hi uss ki tauba hai. Iss liye uss ko aakhirat mein, insha allah, koi saza na hogi.

Nabi s.a.w. ke daur mein, Iss shaks ke talluq se 2 groh wo gaye the, ek groh iss shaks ko bura kehta tha keh wo barbaad ho gaya, aur dusra groh kehta tha keh ma’aiz ki tauba se afzal kisi ki tauba nahee.

3 dinn baad, nabi s.a.w. ne sahaba se kaha,
«اسْتَغْفِرُوا لِمَاعِزِ بْنِ مَالِكٍ»، قَالَ: فَقَالُوا: غَفَرَ اللهُ لِمَاعِزِ بْنِ مَالِكٍ، قَالَ، فَقَالَ رَسُولُ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «لَقَدْ تَابَ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ أُمَّةٍ لَوَسِعَتْهُمْ»

Tarjuma:
Magfirat ki dau mango ma’aiz ke liye.
Sahaba ne kaha, ALLAH bakshe ma’aiz ko.
Phir nabi s.a.w. ne farmaya,
Ma’aiz ne aisi tauba ki hai keh agar wo tauba ek ummat ke logaun par banti jaye to sab ko kaafi ho jaye.
(Sahee Muslim : 4428)

Iss hadith ke tukade se maloom huwa keh Hzrat Ma’aiz r.a. ki tauba qubul ho gayi thi. Iss liye ab unhein aakhirat mein koi saza nahee milegi, insha ALLAH.
Iss liye, iss hadith se yehi istedlaal nikala keh, zani ko agar dunya mein sangsaar kar diya jaye to wahi uss ki tauba hai. aur ye afzal tauba hai.
