Jawab:
Iss masale mein ulema-e-salaf wa khalaf mein kaafi ikhtelaaf hai.
Ye masala bada pecheeda hai. Iss talluq se lab kushayi mehangi padh sakti hai.

Aur iss masale ke bayan karne mein muzh se galti ke saadir hone ka poora poora imkan hai. Iss zimen mein koi bhi ilmi eatebaar se meri islah kar sakta hai aur main sharah sadar se iss ke liye tayyar hoon.
Behre haal main apni bisaat bhar koshish karoonga ke iss masale mein kuch supurde qalam karoon.
Haq baat ke bayan karne mein ALLAH hamari madad kare, aur haq baat ki taraf hamari sahee rehnumayi farmaye. Aameen.

Mayyat ki taraf se qurbani karna durust nahee hai.
Iss talluq se koi sahee hadith nahee milti jiss mein baraye raast ya isharatan iss masale par roshani daali gayi ho.

Iss masale ko samazhane se pehle ye baat samazh lein ke qurbani har sahab-e-isteta’at par wajib hai. Iss mein sahab-e-nisab ki koi shart nahee hai.
Yani jo bhi jiss halat mein qurbani kar sakta ho, wo qurbani zarur kare.
Qurbani ka poora nizam zinde logaun par munhassir hai.

Qurbani ek khaas ibadat hai jiss ke talluq se ALLAH aur uss ke rasool s.a.w. ne humari rehnumayi farmayi hai.

Aayiye, Chand sawal khade karte hain, phir unn ke tajziye se iss masale ka hall talash karte hain,
Sawal ye hain,
Jab qurbani sahab-e-Isteta’at par wajib hai to,
1. Kya Mayyit bhi sahab-e-isteta’at hai?, agar nahee to qurbani matt kijiye.
2. Agar hai to haar saal uss ke naam se qurbani karna wajib huwa?
3. mayyit mein khas wa aam ki koi qaid nahee hai, door wa nazdeek ki bhi koi qaid nahee hai, to phir harr peedhi ki qurbani karna wajib hai, jaise maap baap, unn ke maap baap, phir unn ke maa baap ….

Agar mayyit ki taraf se qurbani ka maqsad esaal-e-sawab hai, to yaad rahe aap s.a.w. ne esaal-e-sawab ke 3 zariye batayein hain unn mein mayyit ke naam ki qurbani ka zikar nahee hai,
Hadith iss tarah hai,
عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، قَالَ: ” إِذَا مَاتَ الْإِنْسَانُ انْقَطَعَ عَنْهُ عَمَلُهُ إِلَّا مِنْ ثَلَاثَةٍ: إِلَّا مِنْ صَدَقَةٍ جَارِيَةٍ، أَوْ عِلْمٍ يُنْتَفَعُ بِهِ، أَوْ وَلَدٍ صَالِحٍ يَدْعُو لَهُ ”

Tarjuma:
Abu Hiraira r.a. se riwayat hai aap s.a.w. ne farmaya,
Jab insan mar jaata hai to uss se uss ka amal munqata’a ho jaata hai (yani ab wo amal nahee kar sakta). siwaye 3 cheezaun ke (yani 3 cheezun se uss ko sawab milta rahega)
1. Sadqa-e-Jariya wala amal chore mare,
2. Nafa bakhsh ilm chore mare,
3. Nake aur Saleh aulad chore mare jo uss ke liye dua karti ho.
(Sahee Muslim – 14/1631 , Sunan Tirmizi-1376 , Sunan Abu Daud-2880 , Sunan Nasai-3651)

Iss hadith mein jin zariyaun ka zikar hai jiss se marne wale ko sawab milta rahega, wo uss mayyit ka khud ka amal hai, jo uss ne marne se pehle kiya tha.
Agar uss ki nake aur saleh aulad uss ke liye dua karti hai ya koi nake amal karti hai to uss ko bhi sawab milega. Yani agar uss ki aulad qurbani karti hai to uss ko bhi iss mein se sawab milega, aur aulad hone ki wajah se ye sawab-e-jariya hai iss liye dono ke sawab mein koi kami nahee hogi. To phir aulad ko khaas taur par mayyit ki taraf se qurbani karne ki kya zarurat hai?.

Iss zimen mein ek hadith pesh ki jaati hai hzrt ALI r.a. ki keh unhaun ne aap s.a.w. ke naam se qurbani ki thi.
Magar ye hadith sahee nahee hai. Lihaza iss hadith se istedlaal karna bhi durust nahee.
(Mazeed wazahat ke liye, mera ek jawab dekh lein ke kya nabi s.a.w. ke naam se qurbani kar sakte hain?)

Ek ishkal yahan ye paida hota hai keh nabi s.a.w. ne to apne ummatiyaun ke naam se qurbani ki hai to hum aap s.a.w. ke naam se qurbani kyun na karein?
Iss ka jawab ye hai keh nabi s.a.w. ne apni ummat mein unn logaun ke naam se qurbani ki hai jo qurbani ki taqat na rakhate hoon.
Jaisa keh hadith ke ye alfaz hain,
هَذَا عَنِّي وَعَمَّنْ لَمْ يُضَحِّ مِنْ أُمَّتِي

Tarjuma:
Ye qurbani meri aur mere unn ummatiyaun ki taraf se hai jo qurbani nahee kar sakte.
(Sunan Tirmizi – 1521 , Sunan Abu Daud – 2810 )

Hadith ke alfaz se saaf wazeh hai keh agar hum qurbani kar sakte hain to aap s.a.w. ki wo qurbani hamare liye nahee thi.
Issi tarah agar hum aap s.a.w. ke naam ki qurbai karte hain to iss ka ek maana ye bhi nikalta hai ke aap s.a.w. qurbani nahee kar sakte the, magar ye baat bilkul durust nahee hai, aur nabi s.a.w. ki shan mein gustakhi bhi hai.

Aayiye ek hadith dekhate hain jiss par amal karne se dono qisam ke qayileen ki murad poori ho sakti hai.

عَطَاءَ بْنَ يَسَارٍ يَقُولُ: سَأَلْتُ أَبَا أَيُّوبَ الأَنْصَارِيَّ: كَيْفَ كَانَتِ الضَّحَايَا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟ فَقَالَ: «كَانَ الرَّجُلُ يُضَحِّي بِالشَّاةِ عَنْهُ وَعَنْ أَهْلِ بَيْتِهِ، فَيَأْكُلُونَ وَيُطْعِمُونَ حَتَّى تَبَاهَى النَّاسُ، فَصَارَتْ كَمَا تَرَى»

Tarjuma:
Ataa bin Yasaar kehte hain, maine Abu Ayyub al-ansari r.a. se poocha,
Aap s.a.w. ke zamane mein qurbaniyaan kis tarah huwa karti thien?
To unhaun ne kaha, keh
Ek shaks ek bakari ki qurbani karta tha, apni taraf se aur apne ghar walaun ki taraf se. lihaza wo ussi mein se khate the aur logaun ko bhi khilate the, yahaan takk keh log (ziyda qurbaniyan karne mein) fakhar karne lage, jaisa ke aaj kal tum dekh rahe ho.
(Sunan Tirmizi – 1505)

Iss hadith mein bataya gaya hai ke qurbani ke liye ek bakri ya ek hissa poore ghar walaun ki taraf se kaafi ho jaata hai.
Agar hum iss hadith ko sirf zindaun par mahmool karte hain to zahir si baat hai ghar ke zinde jitne afrad hain sab ki qurbani sirf ek bakri se ya ek hisse se ho jati hai. Aur maayit ki taraf se qurbani na karna bhi sabit ho jata hai.
Agar hum iss hadith mein murdaun ko bhi shumaar kar lein iss wajah se keh wo bhi ghar ke afrad mein dakhil hain, to sirf ek bakri ya ek hissa unn ke lie bhi kaafi ho jayega. Alag se unn ke naam se qurbani karne ki zarurat nahee rahegi. Aur waise bhi ALLAH ke paas sawab ki kami nahee hai, hamare ek amal se, khandan ke zindaun aur murdaun ko beshumar sawab de sakta hai, shart ye hai keh hamara amal kitab wa sunnat se sabit ho.
